David Beckham has just been handed a driving ban and a fine for his antics behind the wheel. What happens if you have an employee who has received the same penalty?
The first question is whether they drive for a living? If not, its unlikely to make much of a difference. As long as they can get to and from work in a timely fashion.
If however they do drive for a living, consider the penalty given. If there is a ban? How long is this for? Can they perform another role whilst this is in force? If not or if it's a lengthy ban, there could be a potentially fair reason to dismiss if the employee could not continue to work in the position held without contravening a duty or restriction imposed by law.
Employers will still need to follow a fair process in any disciplinary situation but dismissal may be a legally fair and a reasonable outcome.
